A Divorce Attorney in Conroe, TX — Right Where You Need One

If you are going through a divorce in Conroe or Montgomery County, the attorney you hire should already know the local courts — not be learning them on your time. Our office at 141 N. San Jacinto Street, Conroe TX 77301 is steps from the Montgomery County Courthouse. We practice before the 418th District Court, the 410th District Court, and County Court at Law No. 3 regularly.

A Texas divorce turns on four interconnected issues: property division under community property law, conservatorship and possession of any children, child support figured under Texas Family Code guidelines, and spousal maintenance where eligibility is met. Handling each issue correctly — and in the right sequence — requires an attorney who understands both Texas family law and the specific practices of the courts where your case will actually be decided.

Flat-Fee Uncontested Divorce Available

When both spouses agree on all terms, qualifying cases can use our flat-fee uncontested divorce through our uncontested divorce service — one of the most cost-effective divorce options in the Conroe area. A free consultation will tell you whether your case qualifies.

Whether your case is a straightforward separation or involves contested custody, significant assets, business interests, or a difficult spouse, we provide clear, direct representation from filing through final decree. For Conroe residents, The Woodlands families, Magnolia clients, and everyone else in Montgomery County — our office is local, our attorney is experienced, and our approach is personal.

Montgomery County Family Law Courts

We Practice in Your Local Courts Regularly

Divorce and family law cases in Montgomery County are heard at the Montgomery County Courthouse in Conroe, and our office is steps away. We appear in all three courts regularly.

Montgomery County divorce cases are assigned among these three courts. Each one has its own local rules, scheduling preferences, and approach to temporary orders and contested hearings — appearing in them regularly is a concrete advantage.

Contested vs. Uncontested Divorce in Montgomery County

Contested Divorce in Conroe TX

When spouses cannot reach agreement on property division, custody, or support, the case moves through litigation in the Montgomery County Family Law Courts. Temporary orders keep things stable while the case is pending — covering who stays in the family home, temporary custody and support, and restraining orders on assets.

Discovery, mediation, and finally a trial before the assigned judge decide the outcome. Our firm builds contested divorce cases from the ground up — preserving evidence, documenting assets, and establishing the factual record that drives results at both mediation and trial.

Uncontested Divorce in Conroe TX

When both spouses agree on all terms — property, children, support — the process is far faster and less expensive. Texas requires a 60-day waiting period from filing; uncontested divorces often conclude shortly after that window closes, provided the proper paperwork is in place.

For qualifying Conroe-area cases, we offer flat-fee uncontested divorce through our uncontested divorce service — a simple, affordable path once both parties have reached full agreement. Montgomery County court filing fees are separate from attorney fees.

The Four Issues in Every Texas Divorce

01
Property Division

Just and right division of community property under TFC § 7.001 — real estate, accounts, retirement, business interests, oil & gas assets, and debt allocation

02
Child Custody

Conservatorship (legal decision-making) and possession schedule — who the children live with and when each parent has access under TFC Chapter 153

03
Child Support

Calculated on Texas statutory guidelines under TFC § 154.125 — monthly support, health and dental insurance, unreimbursed medical, and childcare

04
Spousal Maintenance

Court-ordered maintenance under TFC § 8.051 where eligibility is met, or contractual alimony agreed by the parties — amounts and duration negotiated or litigated

Why a Local Conroe Divorce Attorney Matters

Montgomery County has grown dramatically over the past decade — Conroe, The Woodlands, Magnolia, and the surrounding communities are now home to hundreds of thousands of residents, many with complex finances that include oil and gas interests, energy sector employment, real estate investments, and business ownership. A divorce involving these assets calls for both Texas family law expertise and familiarity with the local courts that will decide the case.

When you hire a firm from outside Montgomery County to handle your Conroe divorce, it is learning unfamiliar local procedures on your dime. When you hire our firm, you get an attorney who has been practicing in the Montgomery County Family Law Courts for years — who knows the local docket, the local expectations, and what it takes to get results here.

Our office at 141 N. San Jacinto Street, Conroe TX 77301 — phone (936) 298-8000 — sits directly across from the Montgomery County Family Law Courts. That closeness is more than a convenience. It reflects our commitment to this community and this court system.

Conroe is the county seat of Montgomery County — and the Birthplace of the Lone Star Flag. Our office at 141 N. Did You Know · Birthplace of the Lone Star Flag
Montgomery County: Birthplace of the Texas Flag

Montgomery County is the home of the original Lone Star Flag of the Republic of Texas. The Texas Flag Code gives meaning to each color and to the single star itself:

Blue · Loyalty White · Purity Red · Bravery

The single Lone Star stands for all of Texas — a symbol of our unity as one for God, State, and Country. The flag was designed right here, in this county. We think that matters.

A Few Things About This County You Might Not Know

Montgomery County, Texas — A Short History

1687
First European Through These Lands

French explorer René Robert Cavelier, Sieur de La Salle apparently crossed what is now Montgomery County in 1687 — one of the earliest documented European footprints in Southeast Texas.

1837
Founded in the Lake Creek Settlement

The town of Montgomery was established in July 1837 by W.W. Shepperd on 200 acres within the Lake Creek Settlement. Shepperd and John Wyatt Moody named it after Montgomery County, Alabama — itself named for Lemuel P. Montgomery, who was killed at the Battle of Horseshoe Bend.

Dec 14, 1837
Montgomery County Created

Montgomery County was created on December 14, 1837 — the third county established by the Republic of Texas. The town of Montgomery served as its first county seat for more than fifty years.

1844
First Public Water Well

Montgomery's first public water well was dug in 1844 by Col. Joseph Bennet at a cost of $202.50, covered by the Commissioner's Court. The well still stands today in the stone fence along the south side of what is now the Community Center on College Street.

1889
County Seat Moves to Conroe

In 1889, the county records moved from Montgomery to Conroe — and Conroe has remained the county seat ever since. Today the Montgomery County Courthouse at 301 N. Main Street is where every divorce, custody, and family law matter in this county is decided.

Divorce FAQ — Conroe & Montgomery County, TX

Texas imposes a mandatory 60-day waiting period that runs from the filing date before any divorce can be finalized — no exceptions apply in Conroe or Montgomery County. When both spouses agree on all terms, an uncontested divorce often closes within a few weeks of the 60-day mark once the proper paperwork is filed.

Contested divorces filed in the Montgomery County Family Law Courts — the 418th District Court, 410th District Court, or County Court at Law No. 3 — usually take from six months to more than a year, depending on how complex the property and custody disputes are and whether the case goes to trial. Local docket scheduling and the specific judge assigned also affect the timing.

Divorce and family law cases in Montgomery County are heard at the Montgomery County Courthouse in Conroe. Three courts handle these family law matters:

The 418th District Court, the 410th District Court, and County Court at Law No. 3. Cases are assigned among these three courts. Our office at 141 N. San Jacinto Street is steps from the courthouse. We appear in all three courts regularly and know the local docket practices and expectations specific to each.

To file for divorce in Texas, one spouse must have been a Texas resident for at least six months. To file specifically in Montgomery County, one spouse must also have lived in the county for at least 90 days immediately before filing.

Conroe proper (77301–77306, 77316, 77318, 77384, 77385), The Woodlands, Magnolia, Willis, Montgomery, and other unincorporated parts of Montgomery County all qualify for filing here. If you have relocated recently, we will confirm your eligibility during a free consultation.

Yes. Under Texas Family Code § 7.001, the court divides community property in a way that is “just and right” — and fault in the breakdown of the marriage is one factor the court weighs. Texas recognizes fault grounds that include adultery, cruelty, abandonment, and felony conviction.

When fault is proven, the wronged spouse may receive a disproportionate share of the community estate. Fault must be properly pleaded in the petition and backed by evidence at trial — an allegation on its own produces nothing. Whether to plead fault, and how to prove it, is a strategic decision your attorney makes early in the case.

Filing first does not decide the outcome of a Texas divorce — property is still divided on a just and right basis and custody still turns on the children's best interest, regardless of who filed. Filing first does carry practical advantages, though: the petitioner chooses the county and court, can request temporary orders right away, and sets the initial narrative in the petition.

When spouses live in different counties, or where time-sensitive asset protection or custody issues exist, filing first in Montgomery County can be strategically important. We can advise you on timing as part of your free consultation.

From our office at 141 N. San Jacinto Street, Conroe TX 77301, we serve clients across the Conroe area, including zip codes 77301, 77302, 77303, 77304, 77305, 77306, 77316, 77318, 77384, and 77385, along with nearby Montgomery County communities such as The Woodlands, Magnolia, Willis, Montgomery, and New Caney.

Yes. For qualifying Conroe and Montgomery County cases in which both spouses fully agree on all terms — property division, child custody and support, and spousal support — we offer flat-fee uncontested divorce through our uncontested divorce service. Montgomery County court filing fees are separate from the flat-fee attorney charge.

Flat-fee divorce is not a fit when there are significant disputes, contested custody, complex asset division, or an uncooperative spouse. If you are unsure whether your situation qualifies, a free consultation with our Conroe office at (936) 298-8000 will give you a clear answer.
